These Terms of Use (“Terms”) govern your use of the Gishty website, newsletters, membership programs, and any related content or services provided by Sham Jaff (“Gishty,” or “Sham”).
By subscribing to Gishty's newsletters, you agree to this Terms of Use. If you do not agree, please do not use Gishty's services.

Gishty is a digital platform providing curated journalism, commentary, and newsletters, including (but not limited to) What Happened Last Week, The Goodies, and You Should Probably Read. Gishty operates from Germany, and may use third-party tools or services to deliver Gishty's content.
Your use of the Site constitutes a legally binding agreement governed by these Terms, together with Gishty's Privacy Policy, Cookie Policy, and any other documents referenced herein.
To use Gishty's services, you must be at least 18 years old (or the age of majority in your jurisdiction). You may be required to create an account to access certain features, including VIP or paid subscriptions.
You agree to provide accurate, current, and complete information when registering, and to maintain the security of your account credentials. You are responsible for all activity occurring under your account. Paid accounts may not be shared with others unless written permission is granted, or your paid account specifically allows for "multiple seats".
Gishty reserves the right to suspend or terminate accounts if false information is provided, or if Gishty suspects misuse, fraud, or violation of these Terms.
Certain features or newsletters may require payment (“VIP Subscription”). Unless otherwise stated, all fees are stated in Euros and are inclusive/exclusive of applicable taxes as required by law.
Payment processing is handled by trusted third parties (e.g. Patreon, Substack, Stripe, PayPal), and Gishty dooes not store your financial information. By subscribing, you authorize these providers to charge your chosen payment method on a recurring basis until cancelled.
Cancellations take effect at the end of your current billing cycle. For paid subscriptions to newsletters, consumers may have a statutory right of withdrawal. Where applicable, this right expires 14 days after the conclusion of the contract. Any voluntary refunds outside statutory rights are granted at discretion.
Gishty reserves the right to modify pricing, features, or subscription terms. Subscribers will be informed by email at least 30 days in advance. If a subscriber does not agree to the changes, they may cancel their subscription before the changes take effect.
All content on Gishty — including articles, text, graphics, photographs, videos, logos, code, and design — is the exclusive property of Gishty or its contributors and is protected by copyright, trademark, and other applicable intellectual property laws.
You may access and read content for personal, non-commercial use only. Any reproduction, distribution, public display, modification, or creation of derivative works from Gishty materials requires Gishty's prior written consent.
If you wish to republish or quote material, you must credit the source clearly and provide attribution as required under applicable journalistic and copyright standards.

Gishty reserves the right to moderate comments, remove content, and restrict access to maintain a respectful environment.
Gishty provides journalistic and editorial content created by professional contributors and editors. While Gishty strives for accuracy, completeness, and fairness, all content is provided “as is” and without warranty of any kind.
Opinions expressed in newsletters or articles are those of the authors and do not necessarily reflect the official views of Gishty. Gishty does not guarantee that information will remain accurate, timely, or suitable for any particular purpose.
To the maximum extent permitted by law, Gishty and its directors, officers, employees, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of (or inability to use) the site or services, even if advised of the possibility of such damages.
Our total aggregate liability for any claim related to these Terms shall not exceed the amount paid by you (if any) for the applicable service during the three months preceding the event giving rise to the claim.
Some jurisdictions do not allow certain limitations, so parts of this clause may not apply to you.
You agree to indemnify, defend, and hold harmless Gishty, its affiliates, employees, and contributors from and against any claims, liabilities, damages, losses, or expenses (including legal fees) arising out of your violation of these Terms or misuse of Gishty's services.
Gishty may contain links to third-party websites, services, or platforms. Gishty is not responsible for the content, security, or privacy practices of these external sites. Your interactions with such third parties are solely between you and them, and subject to their own terms and policies.
Gishty collects, processes, and stores personal data in compliance with applicable privacy laws, including GDPR, PIPEDA, CCPA, and PECR. Gishty's data practices are detailed in Gishty's Privacy Policy, which forms part of these Terms by reference.
By using Gishty, you consent to Gishty's handling of your data as described therein.
Gishty may suspend or terminate your access to Gishty at any time, without notice, if it reasonably believes you have violated these Terms, engaged in misconduct, or compromised the integrity or security of Gishty's services.
Upon termination, your right to use the service ceases immediately, though certain obligations (e.g. payment due, indemnities, IP rights) survive termination.
These Terms shall be governed by and construed in accordance with the laws of Germany, without regard to its conflict of law provisions. Disputes shall be subject to the exclusive jurisdiction of the courts in Berlin, Germany.
Nothing in this clause limits your rights under mandatory consumer protection laws in your country of residence.
Gishty reserves the right to modify or update these Terms at any time. Users and subscribers will be informed of any changes to these Terms 4-weeks before changes will come into effect. Users and subscribers will have the option to reject changes and have their accounts permanently deleted.
